Contractual framework

Access to the Pylote API is provided free of charge in exchange for the partner’s commitment to implement profile-view tracking. This tracking is an essential element of the contract’s balance. The contract is for an indefinite term. Either party may terminate it with 30 days’ written notice.
Pylote may terminate the contract immediately and without notice in the event of a breach:
  • Of the tracking obligation (Article 6)
  • Of the upkeep of the Whitelist (Article 4)
  • Of the data protection obligations (Article 12)

Documentation compliance

The technical documentation at https://documentation.client-p.pylote.io/ constitutes the technical reference for the API. It may evolve to reflect API updates. In the event of a substantial change (endpoints, data formats, authentication), Pylote will notify you by email within a reasonable time before it goes live.
You have 15 days after notification to bring your integration into compliance with the documentation in force. Beyond this deadline, Pylote may suspend access to the API without compensation, or terminate the contract.

Personal data and GDPR

Pylote Profiles contain personal data within the meaning of the GDPR (EU Regulation 2016/679).

Responsibilities

Each party acts as an independent data controller:
There is no processor relationship between Pylote and the partner. Each party applies the GDPR independently.

Your GDPR obligations

  • Process the data exclusively to connect recruiters with freelancers
  • Refrain from any unsolicited commercial prospecting, resale or unlawful profiling
  • Grant access to the Profiles only to recruiters who comply with the GDPR, under a contract materializing their obligations
  • Indemnify Pylote against any claim, penalty or judgment resulting from unlawful processing by you or your clients

Pylote reserves the right to verify compliance with your GDPR obligations, directly or through an authorized third party.

Confidentiality

The API key, the technical specifications of the API and the Pylote Profiles are confidential information. You commit to:
  • Disclose this information only to people strictly necessary for performing the contract
  • Enforce this obligation on your staff, advisors and subcontractors
The confidentiality obligation applies throughout the term of the contract and for 5 years after its termination.

Terms of use

Prohibitions

You may not:
  • Resell, sublicense or transfer access to the API without Pylote’s written consent
  • Use the Profiles for purposes other than connecting recruiters with freelancers
  • Store data disproportionately to your operational needs
  • Exploit any security vulnerability of the API
  • Build a competing database from Pylote data
  • Present the Profiles in a way likely to harm the freelancers’ image

Recruiter whitelist

Only recruiters listed on the Whitelist may access Pylote Profiles. The partner commits to:
  • Provide the named email, the company name and any information requested by Pylote
  • Keep the Whitelist up to date and notify Pylote of any addition/removal
  • Ensure that no non-whitelisted recruiter accesses the API
  • Inform each recruiter about the use of the Pylote API and the tracking
The company field in the Whitelist must match the name of the recruiter’s company (e.g. “Lutessa”), never the partner’s name (e.g. “Agrega”). This is the name visible to the freelancer.Pylote reserves the right to refuse or request the removal of any recruiter, without justification.

Liability

  • Pylote Profiles are provided as is, without warranty of accuracy or completeness
  • Pylote’s liability is limited to direct damages and capped at EUR 500
  • The partner indemnifies Pylote against any third-party claim related to use of the API
